Findema TERMS OF SERVICE
1. Agreement Overview
This Terms of Service (hereinafter referred to as the "Agreement") aims to clarify the rights and obligations between the Findema software (including website and App) and users (hereinafter referred to as "You"). Before using any services provided by Findema, please carefully read and understand all contents of this Agreement. By using Findema, you acknowledge that you have agreed to be bound by all terms of this Agreement and the Privacy Policy.
2. Agreement Confirmation and Modification
2.1 Using Findema constitutes acceptance of this Agreement and the Privacy Policy.
2.2 We reserve the right to modify the Agreement. Modifications will be notified through in-app announcements or pop-ups and will take effect 7 days after notification. If you disagree with the modifications, you should immediately stop using the services.
2.3 Agreement Termination: Either you or Findema may terminate this Agreement at any time. After termination, you will no longer be able to use any services provided by Findema, and any purchased services will be handled according to actual usage.
3. Service Content
Findema provides patent image search and related value-added services, including image search, patent information viewing, purchase request matching, and agency services.
3.1 Core Features:
- Patent image search (supports similarity comparison by taking photos or uploading images)
- Basic patent information display (including basic information, drawings, legal status, etc.)
- Agency services (platform assists in handling patent matters)
3.2 Auxiliary Features:
- Purchase request service (submit patent purchase request forms)
- Agency services (platform handles patent applications, transfers, and other matters)
- Favorites and search history management (supports filtering by date)
- Feedback (submit usage issues or suggestions, with screenshot upload support)
3.3 Personal Information Management:
- You can register an account in Findema, manage email, avatar, and other information, and view credit balance, order records, usage history, etc., through the "Personal Center" to enjoy personalized services.
3.4 Third-Party Account Login:
- To facilitate quick registration and login, Findema supports logging in via Apple, Google, or Facebook accounts.
- Upon your authorization, we will obtain your publicly available name, profile picture, and email address from the respective platform. For Apple Sign In, the "Hide My Email" feature is supported to protect your privacy using an anonymized relay email address.
- These data are used solely for creating and linking your Findema account and will not be used for any other purpose. You may unlink your third-party account at any time via "Account Settings".
- You understand and agree that the security of third-party account login is governed by the respective platform (Apple/Google/Facebook), and Findema does not access or store your third-party account password.
3.5 Other Services:
- Findema may introduce new features or services from time to time, subject to actual availability in the software.
4. Credits and Payment Services
4.1 Credits Mechanism:
- Image search services deduct Credits per use, with specific deduction standards clearly indicated before use.
- Credits are virtual service measurement units and cannot be withdrawn, transferred, or exchanged for cash.
- Credit validity periods are as specified at the time of purchase. Unused Credits will automatically expire after the validity period.
4.2 Payment Methods:
- Currently, only PayPal is supported for purchasing and paying for credit packages.
- The payment process is handled independently by the PayPal system. Findema does not store sensitive information such as your bank card number or payment password.
- Order information (including order number, amount, and time) will be recorded in the system for billing verification and after-sales service.
4.3 Order Management:
- You can view historical orders in "Personal Center - Order Records."
- If you encounter payment failures, duplicate charges, or other issues, please contact customer service promptly.
- Except for technical failures or system errors, successfully paid orders are non-refundable.
5. Usage Rules
5.1 Account Requirements:
- Registration can be completed via email verification or third-party account authorization. Impersonating others' identities is strictly prohibited.
- Users can set avatars, modify information, and delete accounts (data cannot be recovered after deletion).
- Transferring, renting, lending accounts, or using them for commercial bulk operations or other illegal purposes is prohibited.
5.2 Legal Compliance:
- You must comply with national laws and regulations, refrain from publishing or disseminating illegal information, and avoid infringing on others' intellectual property rights or legal rights.
5.3 Account Security:
- You are responsible for safeguarding your account and password. Findema is not liable for losses caused by leaks, sharing, or theft.
- If you use a third-party account to log in, you must comply with the security policies of the respective platform (Apple/Google/Facebook). Findema is not responsible for security incidents originating from third-party platforms.
5.4 Prohibited Actions:
- Using Findema for malicious attacks, automated script operations, data scraping, or interfering with system operations is prohibited.
- If discovered, Findema reserves the right to immediately suspend or terminate services and pursue legal action.
5.5 Data Standards:
- Uploaded images must be in JPG/PNG format and no larger than 5MB.
- Images should clearly display product features with simple backgrounds free of irrelevant objects.
- Uploading confidential, infringing, illegal, or others' private content is prohibited.
- Using search results to initiate malicious litigation or engage in unfair competition is prohibited.
6. Disclaimer
6.1 Patent data comes from public sources and is for reference only, not constituting legal advice or authorization basis.
6.2 Findema is not liable for service delays or unavailability caused by server maintenance, network failures, or third-party service interruptions (e.g., PayPal, Alibaba Cloud) (servers are located at Alibaba Cloud's US node).
6.3 Users bear all risks and economic losses resulting from using search results, credit services, or third-party payments.
6.4 Findema is not responsible for data loss caused by force majeure, user device issues, or operational errors.
6.5 Findema may link to third-party services (e.g., PayPal, Apple/Google/Facebook login). Findema is not responsible for your use of third-party services or resulting consequences.
7. Intellectual Property
7.1 The interface design, source code, database structure, algorithm models, and other intellectual property of Findema software belong to Zhejiang Zhiyibei Technology Co., Ltd.
7.2 Original rights to user-uploaded images, feedback, etc., remain with the user or original rights holder. You grant Findema a non-exclusive, sublicensable right to use such content within the service scope for functionality and product optimization.
7.3 The third-party login technologies (Apple Sign In, Google Sign In, Facebook Login) and their trademarks are owned by their respective companies. Findema uses them solely under license and does not claim ownership.
8. Functional Details
8.1 Purchase Request Service:
- Submitted purchase request forms will be reviewed by the platform and attempted to match with patent holders.
- The platform does not participate in specific transaction negotiations or assume risks related to transaction fulfillment or fund security.
8.2 Agency Service:
- If you need the platform to handle patent matters, a separate written agency agreement must be signed, specifying service content and fees.
9. Third-Party Statements
9.1 The Findema App is developed based on the DCloud uni-app framework, with some technical services provided by DCloud. For details, see: DCloud User Service Terms.
9.2 Payment services are provided by PayPal, with data processing following its privacy policy: PayPal Privacy Policy.
9.3 Third-Party Login Services:
- Apple Sign In: Complies with Apple's privacy requirements. Uses anonymized email relay via "Hide My Email." See Apple Privacy Policy.
- Google Sign In: Uses Google Account services with OAuth 2.0 encryption. See Google Privacy Policy.
- Facebook Login: Only accesses publicly available information. You may manage permissions at any time in your Facebook settings. See Facebook Privacy Policy.
9.4 We only collect device identifiers (e.g., IMEI/OAID) as necessary for security protection and crash analysis. Location information is not collected unless you actively use related features.
10. Privacy Protection
Information Collection: Findema may collect your email, device information, search records, order data, feedback, and third-party login authorization data during service provision. For details, see the Findema Privacy Policy.
Information Use: We commit to using your information only as necessary to provide services, improve product quality, or fulfill legal obligations. Your personal information will not be shared with unrelated third parties without your explicit consent. You may manage your authorizations and personal data via "Account Settings".
11. Governing Law and Dispute Resolution
The following exceptions apply: (a) any additional applicable terms incorporated herein, or (b) applicable laws in your jurisdiction (e.g., you may have statutory rights to file claims or defend against claims in local courts, including small claims courts):
- This Agreement and any disputes or claims arising from or related to it are governed by the laws of the People's Republic of China, excluding its conflict of laws principles.
- Any disputes, controversies, or claims (whether contractual, tortious, or otherwise) arising from, related to, or in connection with this Agreement, including its existence, validity, interpretation, performance, breach, or termination, shall be submitted to the Shenzhen Court of International Arbitration for arbitration in accordance with the Shenzhen Court of International Arbitration Rules effective at the time of submitting the Notice of Arbitration. The arbitration venue shall be Shenzhen, China, and the arbitral award shall be final and binding on both parties.
